Terms and Conditions
Article 1 – Definitions
In these terms and conditions, the following definitions apply:
- Right of withdrawal: the period during which the consumer may exercise their right to cancel the contract.
- Consumer: a natural person who does not act for business purposes and who enters into a distance contract with the seller.
- Day: a calendar day.
- Long-term contract: a distance contract concerning goods and/or services whose delivery or performance occurs over a period of time.
- Durable medium: any medium that enables information to be stored in a way that allows future reference and unaltered reproduction.
- Seller: the natural or legal person offering goods and/or services to consumers via distance selling.
- Distance contract: a contract concluded through a distance-selling system using one or more means of distance communication up to and including the time of contract conclusion.
- Means of distance communication: any technology that allows the conclusion of a contract without the simultaneous physical presence of the parties.
- General Terms and Conditions: these terms and conditions used by the seller.

Article 3 – Scope
These terms apply to all offers by Laguna Beach Boutique and to all distance contracts concluded between Laguna Beach Boutique and the consumer.
Before a contract is concluded, the consumer must have access to these terms. If this is not possible, the consumer will be informed where the terms can be accessed and will receive a copy free of charge upon request.
For electronic contracts, these terms shall be made available in a manner that allows the consumer to store them on a durable medium.
If specific conditions apply to a particular product or service, those conditions shall apply alongside these general terms. In the event of a conflict, the provision most favourable to the consumer shall prevail.
Article 4 – Offers
If an offer has a limited validity period or is subject to specific conditions, this shall be clearly stated.
All offers are non-binding and may be modified by Laguna Beach Boutique.
Product descriptions are accurate to the best of our ability, and images aim to reflect reality. Obvious errors or omissions do not bind the seller.
Each offer shall clearly state:
- Prices (excluding any customs duties or import taxes, payable by the consumer to the carrier)
- Shipping costs
- The process for concluding a contract
- The right of withdrawal
- Payment, delivery, and fulfilment terms
- The duration of the offer
- Any additional charges
- The option to correct input errors
- The languages in which the contract may be concluded
- Any minimum duration of obligations
- Product variations (such as size, colour, or material)
Article 5 – Contract Conclusion
A contract is concluded once the consumer accepts the offer and fulfils the stated conditions.
For electronic orders, Laguna Beach Boutique will promptly confirm receipt of the order. Until confirmation, the consumer may cancel the order.
Laguna Beach Boutique reserves the right to verify payment details and may refuse an order for justified reasons.
Upon delivery, the consumer shall receive:
- Customer service contact details
- Information regarding the right of withdrawal
- Warranty information
- Any legally required information
Article 6 – Right of Withdrawal
The consumer has the right to withdraw from the contract within 30 days of receiving the goods.
During this period, the consumer must handle the product with care and, where reasonably possible, return it in its original packaging.
The consumer must notify Laguna Beach Boutique of their intention to withdraw in writing or via email within 30 days and return the goods within 30 days of that notification.
Return shipping costs are borne by the consumer, even when goods are returned directly to the supplier.
Article 7 – Return Costs
The consumer is responsible for return shipping costs. Refunds will be issued within 30 days of receiving the withdrawal notice, provided the product has been returned or proof of shipment has been supplied.
Article 8 – Exceptions to the Right of Withdrawal
The right of withdrawal does not apply to goods that:
- Are custom-made or personalised
- Are clearly personal in nature
- Cannot be returned due to their nature
- Are perishable or have a limited shelf life
- Are subject to market price fluctuations
- Are newspapers or magazines
- Consist of unsealed software, audio, or video recordings
- Are hygiene products with opened packaging
Nor does it apply to services that:
- Involve accommodation, transport, or leisure activities on a specific date
- Have begun with the consumer’s consent before the withdrawal period expired
- Relate to lotteries or betting
Article 9 – Prices
Prices will not be increased after contract conclusion, except where required by changes in VAT or other statutory taxes.
Import duties and customs fees are collected by the carrier and are not included in product prices.
All prices are subject to typographical and clerical errors.
Article 10 – Conformity and Warranty
Laguna Beach Boutique guarantees that products conform to the contract, product description, and applicable law.
Manufacturer warranties do not affect the consumer’s statutory rights.
The warranty does not apply if:
- The product has been repaired by the consumer or a third party
- The product has been misused
- Care instructions or legal requirements were not followed
Article 11 – Delivery
Laguna Beach Boutique is responsible for order fulfilment.
Delivery shall take place within 30 days, unless otherwise agreed. If delivery is not possible, a suitable replacement or refund will be offered.
Risk transfers to the consumer once the product has been received by the consumer or an authorised recipient.
Article 12 – Duration and Termination
Indefinite contracts may be terminated by the consumer at any time with a one-month notice period. Fixed-term contracts shall not be automatically renewed unless expressly agreed.
Article 13 – Payment
Unless otherwise agreed, payment must be completed within 7 working days from the start of the withdrawal period.
The consumer must immediately notify Laguna Beach Boutique of any incorrect payment details.
Article 14 – Complaints
Complaints must be submitted in writing within 7 days of discovering the issue. A response will be provided within 30 days.
If additional time is required, the consumer will be informed accordingly.
Article 15 – Applicable Law
All contracts between Laguna Beach Boutique and the consumer are governed by Dutch law, even if the consumer resides outside the Netherlands or the United States.
